According to C. Labor in the current version, for full-time employees the normal duration of working time is 8 hours per day and 40 hours per week (art. 112 line. (1) C. Labor).
The working time is usually distributed evenly, 8 hours a day for 5 days, with 2 days of rest (art. 113 line. (1) C. Labor).
However, following the model of other western states, in March 2022 a legislative proposal for a 4-day working week with a duration of 10 hours per day was registered.
More precisely, the draft law specifies that the norm of working time “it can be 10 hours a day, respecting 40 hours a week” and that “the distribution of working time is established by mutual agreement between the employer and the employee and can be 10 hours a day for 4 days, with 3 days of rest […]”.
If this legislative proposal is approved, it will not have an impact on staff salaries, but it may have an impact in the sense of creating more jobs. More jobs can be created in the situation where the employer would maintain a 5-day work schedule, and for the 5th day he would have to hire additional staff.
We recommend following the legislative process regarding this bill, as it is an aspect you must know when signing an employment contract.
Also, in the situation where this draft law is adopted, the distribution of working time is an aspect that will have to be taken into account in the negotiations of collective labor contracts.
